Apply anti-dumping and countervailing measures


Application

This unit involves the skills and knowledge required to identify goods subject to dumping and/or countervailing measures, and to calculate applicable duties.

Work must be carried out in compliance with relevant customs, legislation and workplace requirements concerning applying anti-dumping and/or countervailing duties.

Work is undertaken in a range of environments in the customs broking industry.

No licensing, legislative or certification requirement apply to this unit at the time of publication.

Evidence of Performance

Evidence required to demonstrate competence in this unit must be relevant to and satisfy all of the requirements of the elements and performance criteria on at least one occasion and include:

advising clients about their obligations in regard to duty assessment

advising clients on the impact/considerations of penalty legislation

advising clients on the operation/aspects of the Australian anti-dumping and countervailing system

calculating dumping export price (DXP)

ensuring currency of relevant legislative and regulatory knowledge

identifying exempt goods and suppliers

identifying inclusive goods and suppliers

identifying relevant country of export

preparing duty assessments

reading and interpreting appropriate Acts and regulations.


Evidence of Knowledge

Evidence required to demonstrate competence in this unit must be relevant to and satisfy all of the requirements of the elements and performance criteria and include knowledge of:

assessing shipments using current government legislation including:

Australian Customs Act and regulations

Dumping Commodity Register (DCR)

Australian anti-dumping and countervailing legislation

content and use of DCR

processes to determine and calculate anti-dumping and countervailing duties.


Assessment Conditions

As a minimum, assessors must satisfy applicable regulatory requirements, which include requirements in the Standards for Registered Training Organisations current at the time of assessment.

Assessment must occur in workplace operational situations where it is appropriate to do so. Where this is not appropriate, assessment must occur in simulated workplace operational situations that replicate workplace conditions.

Assessment processes and techniques must be appropriate to the language, literacy and numeracy requirements of the work being performed and the needs of the candidate.

Resources for assessment include:

a range of relevant exercises, case studies and/or simulations

applicable documentation including workplace procedures, regulations, codes of practice and operation manuals

relevant materials, tools, equipment and personal protective equipment currently used in industry.
